Dear Stitchies user,
we are happy that you already are or would like to become a member of our sewing community! With the Stitchies app, we are developing a powerful multifunctional tool for everyone who loves to sew. The app is designed to support you with your sewing projects, to inspire you and to enable you to exchange ideas with other sewing enthusiasts as well as to establish contact with them. Stitchies also provides you with services and features that allow you to publish your own content (such as texts, comments, images, videos and reviews) and to talk with other users directly. For a peaceful coexistence without conflicts, it is imperative that all members treat each other with respect.
Keeping everything running smoothly requires some basic rules that everyone in the community has to follow. That’s why we have the Stitchies Terms of Use. Please read them carefully, because by registering with Stitchies you agree to them.
Terms of use and legal notices
Each Stitchies user agrees to the following rules and confirms to have read them and to comply with them when registering or logging in to Stitchies, regardless of whether the registration is done directly via the registration form or via the Facebook login in the app.
1 Code of conduct
Each Stitchies user
- acts responsibly and treats other members with respect and on the basis of common decency.
- is responsible for the content he/she publishes, in particular for his/her image and word expressions.
- agrees to publish only content to which he or she holds the copyright or for which he or she has written permission to use from the copyright owner.
- agrees to only publish content that is legal in accordance with German and European law as well as with the legislation in his or her home country. He or she knows that it is also explicitly prohibited to publish or link to content that contains depictions of violence, (right-wing) extremist content, eroticism, pornography or prohibited depictions or symbols.
- knows that it is prohibited to post advertising, chain letters, PR materials or other content serving a commercial purpose via the Stitchies app.
- agrees not to post content that attacks or offends other members in any way.
- agrees, to the best of his or her knowledge, to submit only fair and honest reviews.
- knows that it is forbidden to post reviews for one’s own trade, for the employer’s trade or for the employer’s products.
- agrees to not impersonate other members or publicly make fun of the content they post.
- actively contributes to resolving conflicts quickly and peacefully.
- is obliged to inform the support if he/she finds that problems and conflicts cannot be solved by the users involved.
- agrees to submit accurate information about his or her e-mail address and date of birth when registering and knows that the use of disposable e-mail addresses is prohibited.
- knows that it is forbidden to disclose one’s own account credentials to third parties or to obtain the account credentials of third parties.
- knows that it is forbidden to use the user account of another Stitchies member.
- knows that he/she can contact the support team at any time with questions and problems.
2 Legal notice
2.1 Content liability
The Stitchies team always works with the greatest effort and care on the Stitchies App and all other services we provide. However, as these are constantly changing, it is not possible (especially in the case of content posted by users) to completely screen them, check their content and punish violations of the Terms of Use, the General Terms and Conditions or applicable laws immediately. Within our role as provider of the services available in the Stitchies App, we are only responsible for content published by ourselves and are not obliged to monitor the content published by users or to investigate whether it indicates illegal activities. Obligations to block the use of information or to delete information in accordance with general laws remain unaffected by this.
Each individual user is responsible for all the information he or she publishes, including its up-to-dateness, accuracy, completeness and quality. No liability is assumed by the Stitchies team for this.
If we become aware of any actions of a user that are harmful to minors, offensive, immoral, abusive or illegal, we will remove the relevant information immediately, if this is technically possible and reasonable. As a result, the responsible user will be warned or blocked at our discretion. If damage has been caused, he may also be liable for it.
The Stitchies team reserves the right to partially or completely block or delete posted content or user accounts at its own discretion and without prior notice.
Stitchies is not liable for external content and does not adopt it as its own.
2.2 Links
The Stitchies app contains links to external third-party websites that are not under our control. Some of these links are published by users. The respective operators are always responsible for the content of the linked pages. The Stitchies team therefore accepts no liability for the content of linked pages and does not adopt the content as its own. If we become aware of any legal violations or violations of the terms of use, we will remove the relevant links immediately, if this is technically possible and reasonable for us.
2.3 Intellectual property
All content created by the Stitchies team within the Stitchies app is subject to copyright. Any reproduction of the content requires the prior written consent of us, otherwise it is strictly prohibited. This also applies to the transfer of content to databases or other electronic media or systems.
The contents of the Stitchies App are published without consideration of any patent protection. Trade names are used without guarantee of free use and protected trademarks are not individually identified as such.
Images, videos and texts, if applicable, are protected by copyright. Every Stitchies user is obligated to publish only images, videos and texts for which he or she owns the copyrights or for which he or she has been granted the corresponding rights of use by the copyright owner in a verifiable manner (usually in writing). When publishing pictures or videos showing persons, the consent of all visible persons shown must be obtained.
When a Stitchies user becomes aware of copyright infringements, he is obliged to report them to the support team immediately. If we become aware of any infringements, we will remove the content in question immediately, if this is technically possible and reasonable for us.
2.4 Use at your own risk
The use of the Stitchies App is always at the user’s own risk. The Stitchies Team accepts no liability for any material or immaterial damage suffered by a person or a legal entity as a direct or indirect consequence of the information published in the Stitchies App or as a result of using the Stitchies App. Liability for damages due to non-availability of the content provided via the Stitchies App or due to non-usability of the Stitchies App is excluded.
2.5 Miscellaneous
These terms of use and the disclaimer are to be considered as part of the entire offer within the Stitchies app. If sections or individual terms of this statement are not legal or correct, it does not affect the validity of the other parts of the document. Ineffective provisions shall be deemed to be replaced by such provisions which come closest to the purpose of the ineffective provisions in a legally effective manner. The same applies to any loopholes.
We, as the operator of Stitchies, reserve the right to change, expand, discontinue or restrict the offer in the Stitchies app at any time and also without prior notice, in terms of content as well as extent and structure.
